CDW Coworker - ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM
Event Name: HP hosts CDW at Chileno Bay Resort, Los Cabos, MX
Event Dates: Thursday, June 8, 2023 – Sunday, June 11, 2023

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN THIS ACTIVITY/EVENT/TRIP, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. 

I certify that I am physically fit, able to travel, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this Activity/Event/Trip.

I acknowledge that this Accident Waiver and Release of Liability Form will be used by Events by M, Ltd., and that it will govern my actions and responsibilities at said Activity/Event/Trip. 

In consideration of Events by M’s planning and permitting me to participate in this Activity/Event/Trip I hereby take action for myself, my executors, administrators, heirs,  next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this Activity/Event/Trip, THE FOLLOWING ENTITIES OR PERSONS: Events by M, Ltd., and/or their directors, officers, employees, volunteers, representatives, and agents;

(B)  I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in the previous paragraph from any and all liabilities or claims made as a result of participation in this Activity/Event/Trip, whether caused by the negligence of release or otherwise. 

I acknowledge that Events by M, Ltd. And their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity providing a specific event, activity, service, meal, transportation, or lodging.

I acknowledge that travel can be inherently risky, and I voluntarily assume all risks involved in such travel, whether expected or unexpected. I am hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions that may change, delay or cancel travel. 

The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. 

This shall be effective through December 31, 2099. If any part of this agreement is not enforceable, the remainder of this agreement shall remain enforceable. 

I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT IN WHICH I AM GIVING UP LEGAL RIGHTS AND SIGN IT OF MY OWN FREE WILL.

COWORKER WAIVER AND RELEASE FOR EVENTS

This waiver and release relates to my travel to, attendance at and participation in the HP & CDW  - Chileno Bay Resort, Los Cabos Staycation event currently scheduled to take place on or about Thursday, June 8, 2023 – Sunday, June 11, 2023.  

I represent to CDW as follows: 

• I am at least 21 years of age; 

• I have full knowledge and appreciation of the risks associated with the Event and I have given them careful consideration; and 

• I am physically fit to travel to, attend at and participate in the Event.

I understand and acknowledge as follows: 

• My round trip travel to, attendance at and participation in the Event (collectively “Participation”) is entirely voluntary and is not a condition or requirement of my employment;

• My Participation could result in illness, injury, death, property loss or other damages to me or others(together “Harm”); and

• I am solely responsible for and I hereby assume any and all liability and risks of Harm that may result from or arise out of my Participation.

• I further understand that any contact with bodies of water/swimming pool involves certain risks, including but not limited to: death, drowning, or other personal injury as a result of the area’s conditions, the acts of third parties or other unknown safety hazards, diving injury, skin, eye, lung and ear irritation, injuries resulting from loss of balance and footing on aquatic surfaces, injuries resulting from lack of oxygen, injuries due to conditions of equipment, unpredictability of weather and the water conditions, wildlife, first aid operations or procedures of Releases (as defined herein) and/or others, and that there may be other risks not known to me or not reasonably foreseeable at this time.

This waiver and release of liability shall apply to any and all liabilities, claims, damages, demands, rights of action or causes of action, present or future, known or unknown, anticipated or unanticipated (collectively “Claims”), against CDW for any Harm that may result from or arise out of my Participation. 

 

As used herein, “CDW” shall mean collectively CDW Holdings LLC; CDW LLC; CDW Technologies, Inc.; CDW Canada Inc.; CDW Corporation; CDW Direct, LLC; CDW Government LLC; CDW Logistics, Inc.; and their respective owners, shareholders, members, directors, officers, managers, employees, suppliers, subcontractors, agents and/or affiliates. 

I, on behalf of myself and my heirs, executors, administrators and assigns: 

• Agree to protect, defend and hold harmless CDW with respect to any and all Claims for any Harm that result from or arise out of my Participation; and

• Release and discharge CDW from any and all Claims for any Harm that may result from or arise out of my Participation, including but not limited to those which may arise out of the negligence of CDW.

 

I acknowledge that I have carefully read this Coworker Waiver and Release for Events and I fully understand that by signing this waiver I may be giving up legal rights or remedies that might otherwise be available to me.

CDW Coworker Responsibilities When Attending Events and Incentive Trips

When attending CDW- or partner-sponsored events and/or trips won through incentive programs, CDW coworkers represent CDW and are expected to live-up to the same standards of conduct that apply when in the office. 

 

These standards include the CDW Way Code (our code of business conduct and ethics), the Road to Success Coworker Handbook and all applicable policies. CDW is committed to running our business with honesty, integrity and the highest level of ethics, and whether in the office or on a trip, every coworker is responsible for his/her own actions. CDW holds each coworker and their guest, regardless of position or status, accountable for understanding and complying with the Code, CDW’s policies and the law.

Before attending any such event/trip, you must take a moment to review these documents (accessible on the Policy Library) and consider how these standards could come into play while at the event or on the trip.

I acknowledge that I have carefully read this CDW Coworker Responsibilities When Attending Events and Incentive Trips and the referenced documents, and understand that the standards in these documents apply to my actions while attending the below-referenced event. I also acknowledge that failure to comply with the standards set forth in these documents could lead to disciplinary action, up to and including termination.
